IT attaches SRK's Alibaug farmhouse over several alleged violations

The Mumbai Income Tax Department has provisionally attached Bollywood actor Shah Rukh Khan's luxurious farmhouse, Deja vu Farms, in Alibag area and has issued a show-cause notice to the Bollywood superstar for allegedly committing a criminal offense by acquiring around 19,000 sq m land for agricultural goal but instead constructing a farmhouse. According to the tax probe, Khan, through Deja Vu Farms, made an application for purchase of agriculture land for farming in Alibaug, but subsequently converted the land into a farmhouse for personal use.

"Till now, not a single rupee has been generated by farm activities by Deja Vu Farms".

The property's circle rate is estimated at Rs. 146.7mn, but an official said the market rate would go up to five times. Since Khan couldn't purchase the land in his individual capacity, they devised a mechanism in the form of Deja vu, an official report notes.

In 2011, Namita Chhiba was appointed director of Deja Vu in place of Ajgaonkar. Ajgaonkar was the only farmer (benamidar) against whom the property was acquired from local authorities.


So, after the resignation of Ajgaonkar, there was no farmer in the company.

Under the Act, a benami transaction means any transaction in which property is transferred to one person for a consideration paid or provided by another person.

If that wasn't enough, making matters worse is the fact that under the PBPT Act, which provides for provisional attachment and subsequent confiscation of benami properties, whether movable or immovable.

Sources told Indiatoday.in that investigation has been widened. It was also registered as a private company to further show it as a farm land. As per a complaint filed with the IT department, the department has provisionally attached actor Shah Rukh Khan's bungalow in Alibaug by terming it benami property and filed a report before an adjudication authority to confirm the attachment.
