Reuben Foster will not participate in team activities

Foster's attorney, Josh Bentley, requested a delay in entering a pleafor Foster because the Santa Clara County District Attorney's Office had listed the charges against his client only a few hours earlier.

Foster has been charged with felony domestic violence after being accused of attacking his girlfriend, authorities said. He is also being charged with misdemeanor possession of large capacity weapon magazine.

The 49ers released a statement attributed to chief executive officer Jed York, general manager John Lynch and coach Kyle Shanahan on Sunday night saying that Foster will not be participating in team activities as he goes through the legal process stemming from his February 11 arrest. Foster remains out of jail on $75,000 bail and will return to court on April 30 for a plea hearing.

The 24-year-old Foster, a first-round pick in 2017, is not participating in offseason workouts with the 49ers.

"As previously stated, [Foster's] future with the team will be determined by the information revealed during the legal process", the Niners' statement said Sunday.

"Reuben Foster will not participate in team activities as he is tending to his legal matters".

The 49ers open their offseason program on Monday at the club's training facility in Santa Clara. The victim told responding county sheriff's deputies and Los Gatos police that Foster had dragged her out by her hair, threw her out of the house and punched her in the head eight to 10 times, according to the district attorney's office.

When fullback Bruce Miller was in the midst of legal woes stemming from a domestic incident in 2015, he stayed away from the offseason program; Miller was released prior to the 2016 season after a different arrest for assault. And this time, they attributed the statement to Jed York, John Lynch and Kyle Shanahan. And I predict Foster will go to prison. "He is now facing two strikes, under the three strikes law".

The league, in a statement released last week, said it was going to "continue to monitor all developments in this matter which is under review of the personal conduct policy".

Foster was limited in last year's offseason program as he recovered from pre-draft surgery on his right rotator cuff. Phase 2 covers three weeks as coaches are allowed onto the field with players, while team drills and helmets are allowed the final four weeks in Phase 3.
